Six Month Progress Report of the Joint Technical Working Groups
For the Period:  December 2005 - May 2006

This questionnaire on progress made by each Joint Technical Working Group is requested by the Secretariat of the Government-Donor Coordination Committee (GDCC). It should be completed and submitted to the Secretariat of the GDCC before 29 May 2006. It will be used to prepare a summary progress report for the seventh GDCC Meeting scheduled to be held on 14 June 2006. Please return the completed questionnaire to H.E. Mr. Chhieng Yanara at CDC/CRDB in both soft and hard copies.

A.    Progress in Implementing TWG's Action Plans

  1. Please list below activities in the Action Plans that were scheduled to be implemented during the last six months (December 2005 to May 2006) and provide an update on implementation status of these activities.

  1. There is a consensus that steps are required to enhance the effectiveness of the TWG process in this sector.

  2. It would be useful to facilitate an exchange of experience between sectors on which TWG’s operate more effectively, and how this experience can be shared across sectors.

Penal Code

Draft is ready to go into inter-ministerial meeting committee (IMC)

Code of Penal Procedures

Curren transitional provisions are being draft  by MOJ, will sent to COM after a final approval IMC.

 

Civil Code

Draft is ready to go into IMC.

 

Code of Civil Procedures

Draft adopte by National Assembly, 26 May 2006.

 

Organic Law on the Organisation and Functioning of the Courts

2/3 of the draft have been reviewed by MOJ

 

Law on the Amendment of the Supreme Council of Magistracy

Draft returned to MOJ for re-drafting following abolition of SCM seretariat.

 

Law on the Statute of Judges and Prosecutors

Pending. SCM has also been asked to give further comments.

 

Law on Anti-Corruption

MOJ and French cooperation are ensuring the consistency with the draft of penal procedure code and penal code. Some problems need to be clarified.

 

Develop a clear policy framework on access to information

MONASRI is wating for assistance.

 

Complete the Draft Law Against Trafficking in Person and Sexual Exploitation and submit to COM.

MOJ and MONASRI had met each other to discuss on the Definition of the word Trafficking before sending the draft to the COM.
