Actions

  • To adopt RGC's Policy on Registration and Use Rights of Indigenous Communal Land and pilot interim protective measures (identification, mapping, classification and provisional endorsement of indigenous land legal claims) to safeguard the indigenous community's land in two provinces within the framework of provincial level state land management committees and district working groups as per Sub-Decree #118).

+   Draft Policy on Registration and Use Rights of Indigenous Communal Land was submitted to the Council of Ministers (COM) in May 2007. The draft policy was discussed three times with OBSES of the COM in August 2007.  The content was approved with only minor editorial changes. It is expected that the draft policy, together with the draft Sub-decree, will be discussed at an  inter-ministerial meeting before its submission to a full COM Ministers meeting.

+  Sub-decree on the registration of land of Indigenous People community has been drafted. This draft has been discussed within GS-CLP and it is currently under MLMUPC's review.  The draft Sub-decree will be circulated to relevant stakeholders for e-consultation in early March 2008. It is then expected to be reviewed by CLP members for comments before its submission to the Chairman of CLP/Senior Minister and its members for endorsement.

+   Missions: GS-CLP, MLMUPC (Legal Unit, Dept. of Legislative and Cadastral Officials) and members of TWGL from inter-ministries visited Rattanakiri in December 2007 and Mondulkiri in January 2008 in order to learn from the experiences of pilot projects in three villages for their integration into the draft Sub-decree and for preliminary demarcation of the Indigenous community's land.

+  As for the pilot interim protective measure, the COM issued a Notification dated 14 February 2008 allowing the piloting of registration to move forward in three villages.

+  The two Provincial Departments (Rattanakiri and Mondulkiri) are preparing work plans for the registration of these three piloting communities.

 

 

  • To improve the livelihoods of the rural poor, i.e. 500 eligible households are settled on social land concessions with livelihood support and at least 10,000 hectares of suitable land confirmed as available for social land concessions.

+   The sites for Social Land Concession (SLC) pilot projects in Sambok and Changkrang communes in Kratie District, Kratie Province comprising 3,294.36 hectares; and in Choam Kravien Commune in Memot district, Kampong Cham Province comprising 612.21 hectares had been registered as state private land for SLC. The land use planning process in Kratie has resulted in a proposal for 600 households and the process of selecting beneficiaries is ongoing.

+   According to a December 2006 Aide Memoire between the World Bank and the Government in, the World Bank is expected to finance LASED’s implementation for five years from July 1, 2008 to June 30, 2013. The project is intended to be implemented in three provinces, Kampong Cham, Kratie, and Kampong Thom. Within these three provinces, 20 communes (17 in addition to the current three pilot communes) in up to nine districts will be supported for the preparation and implementation of social land concession subprojects.

+   The Government has confirmed five additional communes in January 2008 to be registered as private state lands for the implementation SLC. In addition, the Government will confirm all twenty viable communes for the LASED project by mid-2008.

+    Further location identification for SLC in commune level shall be integrated in Commune Development Plan.

+  The implementation of field work in SLC site in Memot district, Kampong Cham province has been slow due to CMAC's demining activities in the areas.

+   For the effective, efficient and transparent result, participation is needed. This has led to time consuming for the preparation and implementation of the project.

 

 

 

C.    Implementation Status of the Action Plan on Harmonization, Alignment and Results

Land Sector programme

The process of drafting the Land Policy Framework for Cambodia is underway . A workshop on SWOT Analysis was held in early January 2008 in Sihanoukville. Thematic Workshops on specific topics are expected to be held in the coming months.

D.  Resource Mobilization

  1. Please provide details of your TWG's resource mobilisation efforts since the June 2007 CDCF meeting (including identified resource needs, actual commitments and source of funds, and remaining gaps) and the extent to which these resource mobilisation efforts are linked to an Action Plan or sector programme that includes a budget framework for programming resources and activities within the domain of the TWG.

TWGL Secretariat has received support from CIDA in the amount of US$15,000 for its operation in 2008. A proposal seeking additional resources from the CDC is also consideration.
