June 26, 1995 on the Organization and Functioning of the Council for
Development of Cambodia,

Having seen the sub Decree No. 48 dated on
May 21, 1999 on the Amendment of the Sub Decree No.51 dated on June 26,
1995,

Pursuant to the request
of the Council for Development of Cambodia
Hereby
Decided
Article 1:
To require that the processing
fees be paid for the examination and approval of application for tax
exempted importation of equipment and materials for implementing any
investment or technical assistance projects in the framework of bilateral,
multilateral aid and NGOs.
Article 2:
Agencies implementing projects, in the framework of bilateral,
multilateral and NGOs, shall correctly and adequately prepare the
necessary documents relevant to the request for duty free importation in
compliance with the Prakas of the Council for Development of Cambodia No.
2337 /97 date August 11, 1997 on the guidance for implementation of the
Royal government’s Circular No.03 dated June 12 , 1997 on Forms and
Procedures for the request for tax exemption for the importation of
Equipment and Materials in framework of Grant, Loan and Humanitarian Aid
and submit to Cambodian Rehabilitation and Development Board ( CDC/ CRDB )
, 10 days before the arrival of equipment and materials.
Article 3:
After examination if the application for duty
free importation of equipment and materials is seen to be correct and
adequately as stated in article 2 above, the implementing agencies shall
pay fee for the processing of examining and approval on the application in
an amount of Forty Thousand ( 40.000 ) Riels for each request to the CDC/
CRDB. CDC/ CRDB shall, then, issue a receipt of the amount of fee paid to
the requesting agency.
Article 4:
Revenues accrued from the processing fees, as
stated in article 3 above, shall be used for overhead and operating
expenses for the continued functioning of the CDC/ CRDB.
Article 5:
All project implementing agencies shall
effectively implement this Prakas.
Article 6:
This Prakas shall be effective from July 15 ,
2001 onward.
