TWG Action Plan

98.   The TWG planned to implement two activities and reported progress on all activities:

  1. Establishment of two task forces: (a) development of a land PBA, and (b) systematic land titling in key development project areas (e.g. irrigation). Land PBA has been established and its work has begun (See C below). The second Task Force has also been established but is not yet active.

  2. Establish the TWG-Land Secretariat (including staffing). With the support from Global Donor Platform for Rural Development (Platform), a National Facilitator for TWG-Land was recruited by the MLMUPC and took up his functions in January 2007.   Established in October 2005, the TWG-Land Secretariat has had the support of part-time staff assigned to it by MLMUPC and LMAP.

99.   The TWG also made some acknowledgement and suggestions to GDCC. The TWG recognized that land management and administration is a complex issue and that predicable and sustained funding as well as institutional and individual capacity are key if JMIs targets are to be met.  However, it would also like to stress that: (a) coordination between RGC departments and institutions on jurisdictional issues; (b) coordination amongst Development Partners themselves; and (c) between the RGC and Development Partners can and should be improved. In this regard, efforts are being undertaken toward the development and eventual approval of a Code of Conduct or Partnership Principles which is meant to address these lacunae. Other TWGs may wish to consider such an approach, if they have not already done so.

Joint Monitoring Indicators

100.   Complete preparation of regulations to enforce State Land Management Sub-Decree. Prakas Nr. 42 DNS.BK on State Land Identification and Mapping of State Land and State Land Classification (including 9 Annexes), was issued in March 2006. Criteria for State Land Classification (Annex 10 to Prakas 42) were approved by Decision of Senior Minister MLMUPC in December 2006. Draft of Joint Prakas on State Private Land Use Planning is under discussion between MoI and MLMUPC. Adoption of the Prakas is expected shortly.

101.   Elaborate and Implement Article 18 of the Land Law. Draft Circular on measures against Illegal State Land Holding was submitted to the CofM last September. Adoption by Prime Minister is expected shortly. 

102.   Adopt RGC’s strategy and regulations for the indigenous people. Draft Policy for Preparation for Sub-Decree on Registration and Use Rights of Indigenous Communal Land has been revised and is under further discussion within government and consultation with civil society. Regional Consultation workshops were held in December 2006. The National Consultation workshop is scheduled for the end of January 2007.

103.  To improve the livelihoods of the rural poor, 500 eligible households are settled on social land concessions with livelihood support and at least 10,000 hectares of suitable land confirmed as available for social land concessions. Preparatory work has been completed in two pilots (Kratie District, Kratie Province & Memot District, Kampong Cham Province). In Kampong Cham, 3,970 ha. of land have been surveyed and 990 ha have been classified as state private land and under process of registration. In Kratie 4,500 ha.has been surveyed and natural resource assessment has been completed and classified as private state land and under process of registration. Training on Land Identification and Selection of Target Land Recipients has been held. In August 2006 a request was submitted to MAFF to provide land from cancelled economic land concessions as a third model for piloting on SLC. And while MAFF and LASED undertook last November a field visit to identify such land, the report and decision has not yet been made by MAFF. In December 2006, Development Partners also requested from MAFF clarification on ELCs through TWG Forestry and Environment Secretariat. There has not been an answer to this request.

104.  Develop and implement a Land Management Policy and associated legal framework to improve sustainable utilization of land resources. Land Management component MOU was signed between DANIDA and MLMUPC in October 2006. TA support is planned for 2007-2010. Service delivery models for land use mapping, Land Use Planning (LUP) and commune boundary demarcation have been developed.

105.  Strengthen and expand the scope of land registration by: issuing 300,000 land title certificates in 2006. From January to December of 2006, data for 294,000 land parcels were collected and 282,276 land titles were distributed. This figure represents 94% of the target number.

106.  Increasing the percentage of cases successfully resolved by the cadastral commission: 450 cases successfully resolved out of 800 cased handled in 2006. As from January to December 2006 a total of 798 cases were received (291 resolved, 282 dismissed and 30 withdrawn).

107   Revision of cadastral service fee structure, especially for sporadic and subsequent registration, public dissemination of the new fee structure and stamp duty for subsequent registration. Draft cadastral service fee structure had been reviewed and developed. Alternative models from Laos and Mongolia were studied to assess their practicability to Cambodia.

108.  State land mapping conducted in five districts and results placed in a publicly accessible state land data-base. This activity has been delayed. Mapping is being undertaken in 2 districts on a trial basis. More time is needed for this indicator to be reviewed and changed by the TWGL. Regulations for sub-decree on State Land Management and Guidelines for State Mapping are not finalized yet. Coordination between concerned sector land agencies has proved a challenge. Increased support to the strengthening of provincial state land management authority is judged important if this JMI is to be met.

Implementation status of the H-A-R Action Plan

109.  PBA Land – Land Sector Programme. Based on LAMDP, the MLMUPC is currently working on the formulation of the land sector program and a mid-term expenditure framework. This will be undertaken within the framework of TWG Land. A dedicated PBA task force was established in Dec. 2005. The TWG Land Taskforce on PBA/ land sector programme is supported by the Platform to further harmonize activities in the land sector. Platform support for the Land Sector Program in Cambodia is planned for up to 2 to 3 years by providing international and national facilitators.

110. PBA task force meeting and Training Course on PBA and Sector Programme. With the support of the Platform, TWG-Land, a PBA task force meeting was held on December 12, 2006 followed by a training course on PBA and Sector programme on December 13-14, 2006 for PBA task force members and concerned development partners.

Resource mobilization

111. The TWG reported that it has been able to mobilize resources for the implementation of the Action Plan.
