Action Plan
90.
The TWG reported that the following 11 activities were
scheduled for implementation, and satisfactory progress has been reported
on 7 activities:

Transport Sector Strategy (TSS) (behind schedule).
The first draft of TSS has been completed. The
Inter-ministerial Technical Working Committees are reviewing the first
draft TSS. Among transport sub-sector policies of railway, waterway,
roads, urban roads, and civil aviation, MPWT plans to present the
railway policy, road policy and waterway policy to Council of Ministers
no latter than June 2007.

Reach agreement on a clear transparent mechanism for
budget allocation and disbursement and monitoring for repair and
maintenance of roads.
Since
September 2006, MEF and MPWT have established the Inter-Ministerial
Committee led by MPWT and MEF Secretaries of State to facilitate issues
related to Road Maintenance. Significant progress has been achieved in
terms of prioritization of maintenance works, budget allocation, and
disbursement process for 2007 but discussions need to be continued to
eventually reach agreement on an overall sustainable mechanism,
especially with regard to the adoption of an acceptable road maintenance
management system, timely release of funds and transition from force
account to outsourced contracting.

Submit Road Law to CoM for approval.
Ministry of Justice’s comments on draft Road Law has been obtained and
accepted by MPWT. Draft Road Law will be submitted to CoM along with
draft law of the Right of Way

Road Safety Action Plans.
Draft Land
Traffic Law has been adopted by the National Assembly in Dec 2006. The
adoption lays a very good ground for the implementation of the Road
Safety Action Plan. Due to the countrywide increase of traffic
accidents, it is strongly urged that the effective implementation of
Road Safety Action Plan is urgent. Hence, Financial Assistance is very
essentially required.

Strategic Plan for Rural Roads in
Cambodia.
Strategic Plan for Rural Roads was completed in June 2006.

Submit Telecom law to CoM for approval.
The Draft Telecom Law has been submitted to the National
Assembly since April 2006; the NA Technical Committee has endorsed the
draft law for the debate at the NA. The defense of the draft Telecom law
by MPTC at the NA is on the agenda of the up-coming NA’s meeting.

Telecom Sector Policy Statement (TSPS).
The Draft Telecom Policy Statement has been submitted to
CoM in January 2006. The Telecom Policy Statement is the Supplementary
to the Telecom Law.

Sub-decree of River Basin.
Since
September 2006, final draft of the River Basin Management sub-decree has
been completed by MOWRAM with assistance of consultants from the ADB/AFD
North West Irrigation Sector Project. The draft sub-decree is the
Supplementary to the draft Law of Water Resources Management which is
currently pending adoption at the NA. Upon promulgation of Law of Water
Resources Management the draft Sub-decree will be submitted for the
approval of the Council of Ministers. Regarding this activity, the TWG
requested GDCC is to assist in acceleration of the promulgation of Draft
Law of Water Resources Management by the NA.

Submit Water Supply and Sanitation Law (WSSL) to CoM for
approval.
Submission
of Draft WSSL to CoM in March 2005. OBSESS reviewed the draft in
November 2005; and in early May 2006CoM has requested MIME to revise 17
points. The draft is being revised.

Prepare draft of
Cambodia
National Wood Energy Statistic & Wood Energy Policy (a bit delay).
The National Working Group established in Feb. 2006
consists of 14 persons from 8 different institutions/organizations. The
first meeting of National Working Group was held in March 2006 to
exchange idea / view / the way forward. The study was conducted based on
the existing data gathered from NIS, CFSP. The National Working Group
did not have any fund support from the RGC and outside financing. The
study based on existing data only. We will cooperate with further NGOs
/Sources in formulating the draft policy in order to submit to CM for
inter-ministerial Meeting and further comment/observation. Hopefully, we
could submit the draft by 1st quarter of 2007 in accordance with our
Target Set (1st Quarter of 2007).

Formulation of Civil Aviation Institutional Development
Framework (behind the schedule).
Request
for Aeronautical Technical Assistance is being under consideration by
JICA.

The TWG also appeals to GDCC for the following points:
-
Development Partners support the MEF‘s Public Financial Reform Program,
which is to abolish special accounts, however, not all special accounts,
such as the RFRM. Many transport external funding projects’ performances
are being affected by the issue. The TWG requests MEF to explain
Development Partners on the abolishment of the RFRM to avoid poor rating
on the on-going transport external funding projects.

The IRITWG requests GDCC to seek financial assistances for the
implementation of the Road Safety Action Plans of the year 2007.
-
GDCC should coordinate with the NA for the acceleration of the
promulgations of draft Laws of the infrastructures.

Draft law of
Water Resources Management has been submitted to the NA. However, its
schedule for adoption is unclear.

Law of Civil
Aviation.
Draft Law of
Civil Aviation has been submitted to the NA, however, its schedule for
adoption is unclear.
96.
The TWG did not report on the implementation status of the
H-A-R Action Plan and resource mobilization.
97.
The TWG did not report on fund mobilization.
